LIABILITY INJURY WAIVER, RELEASE & CONSENT AGREEMENT
I, THE
PARENT/GUARDIAN OF THE PARTICIPANT (A MINOR), AM FAMILIAR WITH THE
NATURE OF SOCCER AND INDOOR SOCCER OR THE INTENDED EVENT OF
PARTICIPATION. I (WE) UNDERSTAND THAT PARTICIPATION IN INDOOR SOCCER OR
EVENT OF PARTICIPATION CAN BE DANGEROUS AND COULD POSSIBLY LEAD TO MINOR
INJURIES, BROKEN BONES, BRAIN DAMAGE, INJURY TO INTERNAL ORGANS AND/OR
PARTS OF THE BODY, SERIOUS SPINAL INJURIES, PARAPLEGIA, SERIOUS AND
PERMANENT BODILY INJURY. SUCH BODILY INJURY COULD IMPAIR ABILITY TO
LEARN; TO EARN A LIVING, TO ENGAGE IN OTHER BUSINESS, SOCIAL AND
RECREATIONAL ACTIVITIES AND TO GENERALLY ENJOY LIFE. I ACCEPT ALL RISKS
OF INJURY AND DEATH.
I (WE) ACCEPT THAT ARENA SOCCER CENTERS, INC. dba Off the Wall Soccer IS
ONLY PROVIDING AN OPPORTUNITY TO USE AN INDOOR ATHLETIC FACILITY. IN
CONSIDERATION FOR THE PRIVILEGE TO USE THIS FACILITY I (WE) AGREE TO
ASSUME ALL RISKS AND RELEASE AND HOLD HARMLESS ARENA SOCCER CENTERS,
INC. dba Off the Wall Soccer, ITS STAFF, AGENTS, OWNERS, OFFICERS,
PROPERTY OWNERS, LEAGUE DIRECTORS, OFFICIALS, SPONSORS AND ANY OTHERS
HAVING AN INTEREST IN THE FACILITY FROM ALL LIABILITY, NEGLIGENCE,
CAUSES OF ACTION, CLAIMS, DEMANDS AND DAMAGES OF EVERY KIND WHICH MAY
ARISE OUT OF PARTICIPATION IN ANY AND ALL ACTIVITIES AT THIS FACILITY.
I (WE) WILL ENSURE THAT THE REGISTRANT WILL FAMILIARIZE (HIS/HER)SELF
WITH THE RULES OF THE GAME AND OF THE FACILITY AND WILL TO THE BEST OF
HIS/HER ABILITY PLAY UNDER CONTROL AND AVOID INJURY TO SELF AND OTHER
PERSONS USING THE FACILITY. I (WE) UNDERSTAND THAT THE REGISTRANT'S
MEMBERSHIP AND / OR PARTICIPATION PRIVILEGE MAY BE REVOKED AS OUTLINED
IN THE TEAM / PLAYER AGREEMENT FORM AND IS NON-REFUNDABLE AND
NON-TRANSFERABLE. I (WE) ACCEPT ANY AND ALL RISK AS DESCRIBED ABOVE AND
ACKNOWLEDGE SO BY SELECTING "I AGREE" BELOW. THIS DONE IN LIEU OF A
SIGNATURE.
Consent: I the undersigned parent or guardian/participant do hereby
grant authority to the staff at Arena Soccer Centers, Inc. to render a
judgment concerning medical assistance or hospital care in the event of
an accident or illness during my absence. I do hereby authorize Arena
Soccer Centers, Inc. and its assigns to utilize any and all photographs,
pictures or other likeness of me or anyone assigned guardianship to me,
as they deem appropriate in its promotional materials or team films.
Bouncy
waiver: The
user/participant of the Bouncy Unit does explicitly understand that the
possibility exists that use and/or misuse while using/participating
might result in injury. OFF THE WALL SOCCER, Arena Soccer Centers, Inc.
(OTWS) and its officers, employees and agents is/are not responsible for
any injury incurred by user/participant or any other persons using the
Bouncy Unit. Further, the user/participant cannot hold OTWS, including
all the officers, employees and agents for any kind of injury or claims.
Additionally, the user/participant will not hold OTWS, it’s officers,
employees or agents liable for any costs due to claims from anyone
including attorney’s fees and related costs involving the use of the
Bouncy Unit should legal litigation become necessary.
